Building byelaw breach HC requires details of the cases
The HC of Karnataka guided the Bruhat Bangalore Mahanagara Palike to file a report on the steps taken to clear the huge backlog. While the hearing of petition by Malleswaram Residents’ Welfare Association on rampant violation of building byelaws in the City, a bench of D H Waghela and Justice B V Nagarathna directed the Palike to take proper steps to make sure the disposal of pending cases.
The bench also says that several cases were pending before various courts since the engineers concerned had not submitted the required documents.
The bench also says that the legal cell is working in all these matters. If records are not submitted and the cases are pending then it shows the lack of transparency. They hope that system in place make sure that the engineers submit the document and matters are disposed off.
Chief Justice Waghela says that these cases are of dereliction of duty. BBMP seems to be not fighting as a party but has colluded with party.
The counsel for the Palike submitted that the legal cell was acting like a post office and requires 3 month time to clear the backlog but the chief Justice has refused to give the time.
He further says that the total thing has to be restructured and revamped. If some officers are identified for their careless attitude than such officers should be charge sheeted.
