Buyers want the UP Apartment’s Act implemented

buyersNoida- The Greater Noida West (Noida Extension) home buyers are demanding the Greater Noida Authority and developers for the instant implementation of the UP Apartments Act.

A homebuyer’s group called Noida Extension Flat Owners and Members Association (NEFOMA) made this demand due to the repeated cancellation of bookings and complaints about the arbitrary changes in projects by developers.

In a meeting and a rally held by the members of the buyer’s group in Noida Extension, it was stated that the developers have been  arbitrarily issuing cancellation letters in the absence of the proper regulatory mechanism in the real estate sector.

Few months ago, the members of NEFOMA and Union minister for housing and urban poverty alleviation had a meeting in which NEFOMA addressed the issues faced by them and were apparently promised about the new law being enacted in order to maintain a check on the developers’ cancellation of the projects by the centre.

As per the home buyer’s demand, the UP Apartments Act, 2010 should be effectively implemented in order to protect their rights in the absence of the central legislation. With the implementation of the Act provisions, the buyers will be saved of the booking cancellations or any other changes towards the project.

The buyers have also complained against Greater Noida Authority failing to ensure that the developers follow the UP Apartment Act rules. According to the RTI filed by the NEFOMA members, the developers have not submitted their compulsory 16-point ‘Form of Declaration’ to the Authority as mentioned in the rules of the apartment act 2011.

A NEFOMA member stated  that the developers are demanding the home buyers to sign addendum to agreements which are already made and are lopsided.  However, the buyers are also demanded to pay a higher sum as per the increased cost of materials.
