Court order on Land Act defines guidelines for implementation
Mr. Jairam Ramesh, Rural Development Minister, says that the Supreme Court judgment upholding the retrospective clause of the new Land Acquisition Act has defines rules for the implementation of a significant clause in the law. He further says that the recent judgment was since last 5 years.
He also added that the award was passed in1995 but the parties have not accepted the compensation. That’s why the SC ordered to return the land to its owner.
The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013 passed by the parliament to offer fair compensation to those whose land is taken away for constructing roads, buildings or factories. This act is applicable from 1 January and replaced the 120 year law.
He further says that this judgment is related to the operation and interpretation of Section 24 – the retrospective clause. The bench overturned an old judgment of 2004 of Punjab and Haryana High Court.
He also added that the SC has given clear rules for the implementation of a very significant clause in the law. This act has a far-reaching impact on those who have suffered from arbitrary acquisitions and give life to the intention behind the new law.
