HC pulls up SDMC, SHO over unauthorized development

The Delhi High Court had ordered Archaeological Survey of India (ASI) to seal and demolish the unauthorized construction.

The HC bench of Justice Manmohan pointed out that they are taking serious note of this issue. He also said that there should not be further unauthorized construction when the order of sealing and destroying has been issued. The authorities are taking care that any further unauthorized construction cannot take place.

The direction from the court came while the hearing of this issue in which Mr. Ashok Kumar Soni alleged that the unauthorized construction taking place hardly 300 from the ‘Gandak ki Baoli’ which is restricted under the law.

The bench remarked that this is shocking. There are so many people in this site and they cannot remove so many over night. He also questioned if SHO of this area is performing the duty or not.

On this petition, the Delhi HC has directed the ASI to take proper action and the authority had ordered SDMC to seal and destroy the illegal construction.

The court also pointed out that the demolition should be done according to the rules and for which police help may be provided.
