Land use of capital roads cannot amend without HC approval
On Tuesday, the city government and municipal bodies were stopped by High Court from changing the land use of any road in Delhi without its approval. Commenting on the Court’s order, Justice Manmohan questioned the Government and the three Municipal Corporations to seek a judicial order in a pending petition in the HC on this topic before HC issue new notice.
The bench said that after considering the aforesaid categorical order of the Honorable Supreme Court, restrain has to be exercised by the respondents for issuing any fresh notification from declaring any road in Delhi as commercial/mixed land use without leave of this court in writ petition 4677/1985. The court, at the same time has issued a notice seeking the responses of the Government and municipal bodies by July 17. The order was passed on the plea of Rajouri Garden residents who were unhappy with the Government’s proposal to notify 351 roads in Delhi as mixed land or commercial use.
