Layout plans changes should be informed by builders
Recently, the Department of Town and Country Planning (DTCP) has come up with a new rule, stating that the private developers will now have to notify the flat owners and the investors if there is any change expecting in the layout plan of the projects in Gurgaon.
This directive will surely bring some transparency in the activities of the developers handling the projects.
Now the changes, especially those linked to green belt and open spaces, will not be possible unless the developers have secured concurrence of the flat owners and investors.
In case the plot owners have objections, then shifting of green space or open space in the project will not be allowed. There have been instances in which the builders have fiddled with the main layout plan and shrunk green and open spaces in housing projects in Gurgaon.
But the DTCP’s new rule will help in getting rid of such inconveniences by the allottees and the flat owners and also litigation. The new rule clearly says that the builders have to inform all the plot owners about the proposed changes in the layout plan through a public notice in the newspaper with a request to submit in writing any objection, within a period of 30 days from the date of intimation by the competent authority.
The developer will have to make a copy of the earlier approved layout plan and the proposed layout plan and made them available on the website, at the site office and also in the office of the DTP (Planning) in the district. The developer shall submit the report clearly indicating the petition received from allottees and action taken thereof along with an undertaking to the effect that the rights of the existing plot holders have not been beached.
The rules also says, that if any allottee have any problem with the revised proposed plan, then they will have to file their objection to the concerned DTP district office (Planning). The new rule covers the group housing colonies and the allottees shall submit the objections including the site plan revision or building plan revision.
