New policy for boarding house in residential zone in Gurgaon

Gurgaon- Town & Country Planning Department of Haryana is planning to set up guest/boarding house in residential zones across the state. In order to regulate the functioning of guest houses amidst residential areas, the Haryana government has framed this policy.

As per the policy, only those guest houses constructed on 1,000 sq yard and 2,000 sq yard will be allowed to function against specified commercial conversion fees. The guest houses constructed on 500 sq yard or less-sized plots in Gurgaon will be considered as illegal.

The policy includes that the maximum area that can be permitted for such accommodations in a residential sector shall not exceed 2,000 sq yards.

On an estimate, currently there are around 2000 guest houses in the city of which less than 100 are constructed on 1,000 sq yard plots. The policy curbs setting up guest houses in high-rise buildings. Hundreds of such guest houses functioning from gated communities will be considered as unauthorised.

Such boarding houses can be set up only in residential areas developed under the Haryana Urban Development Authority (HUDA) and private builders only if services such as roads, sewerage system and water supply are ready. Legal guesthouses should be located on a sector road with functional service roads.

If the site is an allotted site of HUDA or is a part of licensed colony, then in such cases, owners are spared of paying external development charges (EDC) because HUDA and the licensee/colonizer pay EDC and include cost of EDC in the cost of plot itself.

Officials said permission will be given to guest houses in localities developed under the Haryana Urban Development Authority (Huda) and private builders only if services like roads, sewerage system and water supply are available.

The policy permits 5,000 sq yards as the maximum area for such guesthouses in a single sector, which means that a maximum of five guest houses will be allowed to operate in one sector.

It has been announced that if any unauthorised guest house is found to be functional in any Huda residential sector, the responsibility will be fixed on the area officer concerned. The area HUDA officers will be given the power to serve notices to the errant plot owners of guest houses.

HUDA has issued ‘non-nuisance certificate’ for taking up commercial activities in residential sectors like opening of offices. But even in that case, commercial use is not allowed for more than 25% space on the ground floor. Also, it is not legal to use any house for the purpose of property dealing.

A regulatory policy will also be formulated on paying guest (PG) accommodations, and till then the PG units would continue to operate.
