Norms on construction of additional floors eased in Delhi
New Delhi- The Delhi residents can now heave a sigh of relief as the government has relaxed the norms pertaining the construction of extra floors in residential flats with multiple ownerships. This step by the government was taken in order to eradicate corruption and get the building plans of the owners sanctioned as early as possible.
According to the government’s latest rule, owners of the third floor in a flat in Delhi need not acquire the no-objection certificate (NOC) from the owners of the other floors to expand the third floor.
As per the higher officials from the governor’s office, the municipal bodies were precisely instructed to not to compel the owners constructing third floors to get an NOC. Perhaps the residents in the existing floors will still have a say to express their grievances to the municipal bodies regarding the expansion of the third floor.
The municipal corporations were directed by the officials from the governor’s office to observe the structural safety and compliance to create bylaws followed by an approval for the construction of a third floor.
The officials also said that approval for the construction of the additional floors will be given by the appropriate municipalities based on the provision of the bylaws. It was stated that the municipal corporation should focus on aspects like non obstruction of passages, structural safety, fire safety, the flow of air and sunlight to the neighboring buildings prior to the approval of the building construction.
However, as mentioned earlier, the existing residents will have an option to express their views pertaining the construction of a third floor within an apartment and appropriate measures will be taken by the municipal corporation based on merit.
The 2021 Master Plan of Delhi (MPD) permitted the construction of third floor in residential areas. In the year 2008, the court permitted the construction of the third floor in residential areas with a norm that the third floor owners need to submit an affidavit stating that the owner will abide the court’s final decision with a validity of MPD-2021.
The current policy by the government focuses about the structural safety and abiding the bylaws along with the parking norms. However, in 2010, the Union Urban Development Ministry had requested for a lift of acquiring the NOC for the third floor owners.
The master plan, MPD-2021 effective from 2007, permits residents to construct a third floor with the height restriction increased to 15 metres from 12 metres.
Henceforth owing to the current norms by the government, there were about around 27,000 building plans being sanctioned for construction.
