PMC Scraps Penalty for Flats Without Completion Certificates
Flat owners in Pune can now relax as they needn’t pay fines for living in apartments that doesn’t have a completion certificate. Previously, people who were residing in flats that didn’t have the necessary document had to pay three times the property tax as fine.
But the Pune Municipal Corporation (PMC) has now done away with the penalty. The proposal to scrap the imposition of fine was approved by the standing committee. However, this rule would only be applicable to residential apartments that rose up between 2005 and 2012.
The committee has decreed that buyers should ask the developers or builders for the completion certificate before they move into the apartment. This order came following the observation by the civic body that the occupants and the builders are not very concerned about the completion and occupancy certificates.
According to the prevailing law, ownership to a property is consummated when the completion certificate is received. As per regulations, when a building is being constructed, the no-objection certificates have to be sought after by the developer from the various government departments like electricity and water supply.
This NoC is testimony to the building construction being done according to the approved plan, without any violation of the rules. When the construction is completed, the property is inspected by civic bodies to ensure that the project was undertaken as per the sanctioned plan, after which the completion certificate is issued.
The builder has to use this completion certificate to receive facilities like water, electricity etc. from the various civic departments. A builder can be denied the completion certificate in the event that he doesn’t provide basic amenities, fails to stick to PMC norms or proceeds with an unapproved construction plan.
There are many developers and builders who sell their property without the necessary document. Even though the certificate is withheld to penalise the developer or builder, it is the flat owner who gets affected as he cannot mortgage or resell the flat without it.
As of now, there has been little progress in penalising the builders who sell their properties without the necessary documents.
