Residents of L&T South City unhappy with relinquishment clause

The residents stand to lose a 5.5 acre park and a 60 feet wide road, which the developer, L&T ECC, had shown as part of their 34-acre residential complex.Residents say that they would not have purchased flats in South City if the 5.5 acre park had not been part of the deal. The park is the main attraction of this property. L&T South City apartments is located in Kothanur Village off Bannerghatta Road.

All sale deeds had mentioned both the park and the road as part of South City. But in 2008, the company started constructing a compound wall, separating the flat-dwellers from the main road and the park beyond. When questioned, L&T ECC officials claimed to have relinquished rights over the park and the road. They had been handed them over to the BDA in 2006 (subsequently, they would go to the BBMP) for the use of the general public. They claimed that the relinquishment clause was mentioned in a separate work order.

Residents are unhappy with this arrangement. Unhappy with breach of the terms mentioned in the sale deed, residents moved court. Company Vice-President D K Narang denied mentioning that the park and road were part of South City’s plot in the sale deed. He claimed that the relinquishment clause was mentioned in a separate work order.

According to Advocate K Pratapan, who represents Sugruha,It’s a clear case of encroachment on property owned by the apartments’ dwellers. He asked that If the company had relinquished the park and road in 2006, how did they include the same in a sale deed executed in 2008? sugruha members suspect that they are being deprived of the park and road at the behest of people who want to develop a 14 acre plot behind South City.

  2. Larger sized ceramic tile floors are easier to install I think than using mosaic tiles. Larger tiles at 12″ by 12″ or 24″ by 24″ cover more area quicker and with a little care can produce an outstanding looking floor

    As per NBC,the distance between, an outdor substation and main building shall not be less than 6m. But this safety clearance is required for movement of Fire Tanker in case of emergecy. No idea about the effect if transformer blast if happen

  12. After having lived in South Bangalore since 1971, in independent houses, I plunged for an apartment in South City during late 2000, purely based on L&T’s impeccable corporate image. In the ‘Agreement to Sell’ L&T averred that I could sign the agreement with my eyes closed considering that the fact that I was dealing with L&T. In the marketing collatorals, papers, title documents, offiicial documents, scaled models and drawings revealed to us or on the ground there was not the remotest clue that the said 34 acres of which I was given a percentage undivided share was in any way impaired. Then to be told some 5 years down the line (I took possession inf February 2001) that a significant part of the land has been given away to the government was a great shock. Under the circumstances wouldn’t I be justified in believing that my faith in L&T has been betrayed? We have sought justice in the courts of law.
