SC Dismisses Jaypee Infratech’s Plea Against NGT Orders
The real estate firm, Jaypee Infratech went to the Supreme Court asking for the Noida Authority to pass the completion certificates for all its projects that are within a 10 km radius from the Okhla bird sanctuary. The buyers of around 4,000 flats that come under this area are waiting for the handover. But without the issue of the completion certificate, they cannot take possession of their homes, towards which they have paid almost 95% of the sale consideration.
But at the Supreme Court, a bench consisting of justices C Naggapan and J S Kehar decided to let the central government take a call on the said issue, before dismissing the firm’s plea against the National Green Tribunal’s interim orders. A disappointed senior advocate who appeared for Jaypee Infratech, A M Sanghvi voiced his thoughts about how this will give rise to a great humanitarian problem for the buyers who have invested a huge chunk of money in these projects.
Earlier on October 28, 2013, the National Green Tribunal (NGT) had released an interim direction which stated that all the building constructions in the area being discussed would need the clearance of the National Board of Wild Life (NBWL), without which no completion certificate would be issued.
The Ministry of Environment granted environmental clearance to all the projects undertaken by this firm in 2007. These projects were started in 2008, and are now unsure with respect to their successful completion after the NGT showed no steps in modifying the order issued recently. The project under question is an integrated township spread over 1,072 acres of land consisting of apartments, flats, houses, plots, schools, commercial, recreational and medical facilities.
