SC to safeguard the interests of the home buyers in the Supertech twin tower case
Supertech, the Noida authority and a group of buyers had filed a petition challenging the Allahabad high court’s order to demolish the twin towers of Supertech’s Emerald Court. The Supreme Court (SC) will hear the Supertech Emerald Court case which involves Noida’s upscale Sector 93A for flouting building norms.
To challenge the Allahabad high court’s order, a group of home-buyers of Supertech’s two sealed towers — Apex and Ceyane — had claimed to file a special petition leave (SLP) in the Supreme Court.
The request of this group from the apex court is that they should either be allowed to take back their refund or shift to another project. This is a logical demand which will safeguard the interests of the home buyers. A separate group had already filed a SLP before the apex court. Request of hat group is that towers should be regularized, and they should get their flats in the same towers.
In its order on April 11, 2014 the Allahabad high court had ordered the demolition of two 40-storeyed under construction residential towers of Supertech’s Emerald Court. It is alleged that they had flouted the building norms, triggering panic among the buyers. The residential towers are a part of the realtor’s Emerald Court project and the towers have 857 flats, of which 627 are sold out.
Following the petitions, the SC on May 5, had stayed the Allahabad high court order.
