Telecom players’ anger on BDA over mobile towers issue

Cell phone towersThe Bangalore Development Authority has issued notice to the building owners over erecting mobile signal towers.

On December 10, an engineer of the BDA issued a notice to a resident of Nagadevanahalli for allowing setting up of a tower on his residential building.

BDA has asked the resident to provide all the documents showing the permission to operate a commercial structure on his property, within seven days. The resident approached the telecom major to provide copies of the necessary documents taken by them.

The BDA also issued notices to some more property owners who allowed towers on their buildings. The building owners informed their respective telecom companies, which have now started to threaten BDA with legal notices.

An advocate of a telecom company said that his client is an infrastructure provider and has all the permission from the government departments and that the firm is a licensee under Section 4 of the Indian Telegraph Act.

The telecom company said that the installation of mobile towers cannot be treated on a par with the construction of any building. High Court judgement stated that the establishment of a mobile tower cannot be considered as commercial usage and the requirement of asking permission from the BDA is very silly.

Senior police and Town Planning officers said that according to town planning provisions, individual residential properties are limited to below 50 feet in height.
