Union Govt plans to draft a new Rent Bill for Delhi

With the new Union Government having been asked by the Delhi High Court to clarify its stand on implementation of the amended Delhi Rent Act 1995, the Centre apparently has plans underway to draft a new Rent Bill for Delhi.

The Union Government will proceed with the drafting of the new Rent Bill for Delhi only after it has sought fresh views from all stakeholders, including the members of the presently-under-suspension Delhi assembly.

This stand of the Union Government with regard to a new Rent Bill for Delhi will be put forth by the Union Ministry of Urban Development in response to a pending petition which has been filed by an association of landlords, challenging the constitutional validity of Delhi Rent Control Act.

Despite the fact that the Delhi Rent Control Act was originally aimed at protecting the migrant population against arbitrary increase in rents by affluent landlords, the Act later came under intense scrutiny because it was reduced to a tool for harassing landlords.

Meanwhile, asserting that a new Rent Bill for Delhi will be drafted after the viewpoints of all stakeholders have been taken into consideration, the UD Secretary has asserted in a prepared note: “There is no proposal for notifying Delhi Rent Act 1995 under consideration of the ministry. To enact a new legislation, a bill to repeal Delhi Rent Act 1995 was introduced in Rajya Sabha and has not been taken up for consideration so far.”
