Q: I am not satisfied with our apartment's recycled water. The recycled water water provided to toilet flush contains lumps of dirts. It doesn't clears the commode perfectly. Most of the top builders always include a clause for compensation to be paid in case of delay in delivering the agreed services. I can understand your situation but delaying the project is not cheating this you should talk to builder and come up with right deadline. I would recommend you to take this as an advantage an talk with developer and tell him to give a deadline or date when you will get possession. Seek your legal expert help and make a compensation clause where you will get compensation if it further delayed.

Q: No progress/Slow progress of construction at Turquoise Project I had booked a flat at Nirmal Lifestyle-Turquoise which was promised for delivery in 2013 but till date the construction has been stopped because of some pending approvals. The approvals were supposed to come by June'2012 but they are still pending in August 2012. Construction has not progressed till date beyond the 2nd Slab for which we have already made 55% of the payment to the builder. Projects by other builders which started at the same time are nearly complete. Pls advise when would the construction start again or if it has started then pls upload latest photographs of the site.. thanx

yes Builders are not following any rules of MOFA. One of my relative had to pay to builder for parking when they bought a apartment. In december the Builder presented us with a bill for 3.75 lacs for water consumed during December 2011 to Dec 2012,when there was no existing PMC water connection till 26th of Dec.2012. I think if they could give out an option for the buyer to choose and pay when he does own an asset to park it makes more sense.
Hi Kapil, It is mandatory that if you are buying a flat then you have to pay for car parking. But it varies from builder to builder. Check the agreement first, is there any clause saying that you can sell or rent your car parking, then go ahead if not then decision will be yours.

I am telling you again and again that please, do not do any booking only on the basis of the brochure, some presentation or looking at a sample flat. Make sure you visit the actual project site and see the location, how well connected the area is city, how are the roads, what is nearby the place and other important factors. A lot of people book properties in real estate expo and exhibition, which I do not think is a good idea at all.

I had a call with the sales guy. it Seems that the rates are 11k for 30% upfront, 10.5k for 40% upfront and 10k for 50% upfront payment.I think it is a decent option for investors. I agree with Jerome.. Also, there are many shopping centres and entertainment facilities in the proximity making it a good locality in terms of investment.. VAT and service tax is only paid for under construction apartment. Service Tax is 3.09% of Total Cost(means 12.36% of 25% of total cost) and VAT is 5.5% of total cost = 8.59% of total cost. Ashirwad Villas is located in the center of MR-10 & MR-11 close to the Bombay Hospital. The prime location and good quality of construction has made sure that a large number of villas and flats are already sold. In fact this project has been a huge success with most of the houses and flats nearing completion. Some 3 BHK villas are still available although pricing would vary on the location and the size of the villa. As it is nearing completion, one can check the interiors being done in various flats and villas to get a good look at the quality of construction. The price range in April-June 2012 was Rs 5000- Rs 5500 per sq ft, while the price range between April-June 2013 was Rs 6000- Rs 6400 per sq ft for a multistorey apartment. In one year, there was an increase of around 19% in property rates due to excellent connectivity and easy accessibility.
The prevailing property prices in the locality ranges from Rs 6,000-7,000 per sq ft whereas, in areas such as Andheri the property values have gone beyond Rs 15,000 per sq ft.

What is the new law for land acquisition for SEZs?
The Union Minister stated that with the earlier Land Acquisition Act, several real estate companies had acquired large chunks of land for realty development in the name of SEZs. The new law will curb this practice. He said that the new law will apply to future SEZ land acquisitions and not the previous ones. He also stated that retrospective provisions in the new Act will apply if the land acquisition happened five years ago or earlier. These provisions will however not apply if land acquisition has happened within five years.

The retrospective clauses in the new bill will apply in three cases. The compensation in all these situations will be according to the new act. 1. If the land award has not been announced under the earlier act. 2. The land award has been announced but physical possession has not yet been taken. 3. A majority of farmers have not accepted the compensation. The Act currently doesn't have a provision for dealing with denotified SEZs.

We did the ‘agreement to sale’ for a flat in Feb 2013... but Sale deed was pending, It was supposed to be done after the final payment to the seller. Now we have cleared all the due. We had already payed the 5% for the stamp duty at the time of Agreement to sale. The redevelopment was to be initially carried out on a public-private partnership (PPP) basis. The housing authority had already issued letters of intent (LoI) for redeveloping these buildings for private developers. However, since work hadn't started, the housing body canceled these LoIs about a year-and-a-half ago. It has now decided to redevelop these buildings by itself. It is expected to call for tenders soon. Apart from these wards, MHADA will also look into other cessed properties it has acquired for redevelopment.
According to MHADA, the plot size of these 27 properties ranges from 7,500 sq.ft) to 43,000 sq.ft. The authority has planned to adhere to either regulations for cessed buildings, cluster housing regulations for plot size of more than an acre, or regulations for regular MHADA buildings.

Q: Why the local body decided to raze these 241 structures in Mumbai? Any reason

Mumbai is set to witness the razing of 241 illegal buildings across 24 wards. These buildings will include both residential as well as commercial buildings. More than half of these buildings are present in five wards. The Brihanmumbai Municipal Corporation (BMC) decided to raze these buildings under sections 351 and 354-A of the MMC (Mumbai Municipal Corporation) Act, and sections 53 and 55 of MRTP (Maharashtra Regional and Town Planning) Act.
About 152 cases are in five wards viz. E ward (Byculla), P-North (Malad), K-West (Vile Parle, Juhu, Andheri West and Oshiwara) and M-West (Mankhurd, Chembur and Govandi). Apart from the buildings being razed, there are several other notices sent to buildings in different wards. The BMC issued as many as 3,700 notices for illegal construction or construction beyond sanctioned plans.

About 50% of these legal notices are stop orders. About 290 have been served in M-East ward (Chembur). There are more than 170 notices issued in L-ward (Kurla) and K-West. There are about 99 orders in C-ward (Bhendi Bazaar) and few more in G-South (Lower Parel, Worli). About 25% are showcause notices and have been mostly issued in the western suburbs. This includes 110 notices in K-West ward, 118 notices in P-North and 96 notices in R-Central ward (Borivali West).
As far as I know some of these cases do not have a time-frame for demolition as court injunctions are sought causing indefinite delays. While the BMC claims that about 2,015 illegal buildings have been demolished, there are only 102 cases that have carried out prosecutions. Out of these, 58 cases are from H-West ward.

Mr Abhi, Let me tell you one thing that as off now prices are fluctuating with regard to properties in Thane west. Yes offcourse you can expect a good return for your property as there is a huge potential for this locality to develop considering various aspects in coming years. As far connectivity is concerned, the project is well linked by road and rail mode of transport. Being close to education institutes, Eastern Express Highway, Pokhran Road, Cadbury factory, the locality seems to be in great demand currently and is turning out to be hot property destination in Thane west.

I have been living in this locality for last 6 years and haven't faced any major power or water crisis as such in this locality. Only during summers one may face unscheduled power cuts for brief period. Absolutely the locality is safe for women who return after late night shifts from work. Actually heard that Hubtown Siddhi is located in Pokhran Raod. It is one of the ongoing projects developed by Hubtown builders. Hi Kishore, As per a recent study undertaken, it seems that Delhi has most no of 2 wheeler riders accounting for nearly 97% followed by Bangalore, Chennai and Pune. Since these vehicles run on petrol they cause the maximum pollution to the environment by emitting harmful toxics and gases.
Hi Sandy, Yeah you are right!!!. If people stop using their own vehicles and take the public transport like local trains, metro trains, buses and monorails, the Indian city roads will be that much free from pollution and traffic chaos. Even the State Govts. are encouraging the public to use public transport as mode of commuting.

The more shocking news is that more than 2 million people are still living in 19672 depleted buildings which may crash at any point of time and it is heartening to know that most of them are living in one room accommodation. Feel so pity and sad for them Yaar.
Yes Ashish, I too feel very bad for these inmates staying in unhygienic conditions in absolute structures and buildings. Since there are no new fresh lands available, the Govt is forced to consider the redevelopment of existing buildings and slums. But redevelopment of the slums and chawls become a reality? Hi Sandeep, How good is the transport and infrastructure available near to the project. Since I am relocating from Hyderabad to Mumbai, looking for a 2 BHK units in this project?? As my office will be in Andheri, shuttling from Vile Parle to Andheri would not be a problem. I am not looking at projects in far off localities like Dahisar, Vasai or MIra Road. Please suggest me.
Hello Ashish, Transport and connectivity is fantastic in this part of the city. BEST buses operate from this area going towards Bandra, Andheri, Khar, Malad and Santacruz. Vile Parle has also a suburban station catering to western line. Fast local trains originating from Mumbai Central and Churchgate going towards Andheri, Jogeshwari, Bhyander, Mira Road and Vasai stop at Vile Parle station. Once the Versova-Ghatkopar metro gets completed, residents living in Vile Parle will be highly benefited as Andheri is just 4.4 kms from Vile Parle.

Mr Sandeep, Yeah the bookings have commenced about 6 months back when the project was launched 8 months back. Heard that they are quoting Rs. 6200 per sqft. Tejas Symphony has 2 and 3 BHK flats having 13 floors each. The area for 2 BHK vary from 1100-1220 sqft and costs approx 68.75 lakh-75.70 lakh. 3 BHK comes with total built up area of 1370 sqft and are priced at Rs. 85 lakhs. Most likely the possession will be due by March 2016.

The project is also located close to Virar station which is only 4 kms away. Hi Sandeep, The locality where the project is coming up is one of the fast developing areas in central Mumbai. Ghatkopar is well connected by road and rail mode of transport quite efficiently.Bus services are available from station to Malad, Mulund, BKC, Prabhadevi, Matunga, Mulund, Dadar and Vashi. The locality also has a station where both fast and slow locals have a brief stop. Autos are available in plenty and besides one can also take the services of city taxi. Eastern Express Highway is also at close proximity from this place. It is an excellent option to buy / invest in a property in this area as one can see good appreciation value in coming times.

Dear Jerome, You should check out the following documents before taking the possession of the flat like possession letter, letter of allotment, No objection letter, agreement letter, sale deed, Blue print / copy of the plan, commencement certificate and project completion certificate. Ensure that you get these documents in hand so that you don't face any problems in future.

Hi Sapna, Better visit the site before investing in any property. Talk with the builder and ask for the legal documents. Verify it by the local body and then go for it. Don't believe in any rumors.

Hi Friends, Even I have booked in phase 1, last year Jan 31st by paying 3.26Lac as down payment, and now there is no response from builder, all the time we have to visit them as they don't provide any reliable information over phone, I have tried getting Mr. Mahindra number but non of their staff provides it, post finally i have got the number of Mr.Jha 9920758444, who is the one of a way to get in touch with Mr. Mahindra owner of company. seriously if I would have invested this amount in any badlapur or ambernath property would have made money by now or if would have invested in bank would have got interest of 10% per annum, I really don't know what are they upto, friends if you get any details please share the same with me too on pankajjsethi@gmail.com
I understand that flat owners of this project has to face a lot of difficulties. Most of them have to pay a monthly EMI, some of them has to pay rent for their flats and couple has to bear both. Check your agreement paper which you have sign at the time of registration. Is there any clause mentioned if yes them consult a property lawyer.

Hi all, Patlipada in Thane west is one of the prime location in thane. It is just 5 min walkable distance from Ghodbandar Road and enjoys seamless connectivity to Mumbai & Thane station. Q: Hi Guys, I have a property in Premier Exotica Kurla Building 3 and am now being asked to pay 3rd installment as well as register the flat. got a letter dated 1st nov. i also got a similar demand notice in oct for which ive paid the installment. They have along with their demand notice attached a letter from Bidco Engineering Division (bandra East) which mentions that construction work of specific property has been completed upto 2nd floor Slab. Should i make the payment and register the flat/document.? What documents should i be asking from them? Can there be a interest payable by them for the construction delay? (bought prior to 2011) can they levy a penalty of 21% p.a (as per their letter) on us for delaying payment of installments ? Will appreciate all the help

Hi Ganesh, If you have paid the 3rd installments, you got a copy of receipt. Visit the developers' office and show the receipt copy of the payment. Secondly, if you got their demand notice which mentions that construction work has been completed upto 2nd floor, you must visit the construction site and see the status of the construction specified in the notice. Further, you have already paid the 3rd installments so it is necessary to register the property in your name. The website igrmaharashtra.gov.in of the department of registration and stamps continued in that state for over three hours.

Hello !!! Pragati owners, Jago Grahak Jago......... The builder has put us in trouble. He is not issuing OC for unknown reasons. I am in trouble because paying a huge interest on Bank loan. With out OC not able to stay there so paying rent too. What to do now, should we collectively and physically meet the builder and request him for his final word or to approach consumer court. This is because if you ask the builder each time he gives some OC commitment but with no result. Please share your views at the earliest.
Even if such a provision for providing completion certificate is not found in the agreement, the builder cannot escape the liability for securing the Completion Certificate and providing a copy thereof to the owner. The law requires the builder to obtain completion certificate of such a building.

Hi its is good that you all are discussing about Chennai reality in this platform. I am the residential person of Chennai and I want to give some light in this point that Chennai is witnessing growth in IT/ITES along the OMR, GST, Mount-Poonamallee road and Ambattur. The NH-4, Oragadam (SH57) and NH5 are also emerging as hot spots for manufacturing, warehousing and logistics related infrastructure. Hence the surrounding areas near the growth corridors would be good investment choices.

The Corporation had decided to start with the green belt project a couple months ago back in the OCtober of 2014 . As far as locality is concerned, for the past few years Kandivali East has been among the top developing localities of the Western suburbs of Mumbai. The reason behind the increasing interest of buyers is this areas connectivity to the Western Express Highway; good infrastructure facilities such as shopping complexes, schools, colleges and affordability in comparison to the fully developed localities of Mumbai.
Right Sandeep, Another reason is the prime reason for the increase in demand in Kandivali East is that the other fully developed areas in Mumbai like Bandra are too expensive and saturated for new buyers. As per Deputy Metropolitan Commissioner, it happened because there has always been a demand for TDR but there was no supply for the last few years. At the same time, there was a slowdown in the real estate sector. Since we are now seeing some level optimism in the sector we decided to sell the TDR to generate funds for funding our projects.

@ Abhinand, The locality is a considerably western suburb, just outside of Borivali and Dahisar. However, Mira Road is very well connected to different suburbs of Mumbai. The Western Express Highway which is a part of NH-8, moves through the area and joins it to areas such as Bandra Kurla Complex and Lower Parel. One can then take the Bandra-Worli sea link to go to South Mumbai. Ghodbunder Road is yet another important highway that connects it to Thane and to Navi Mumbai.

Hi Sandeep, Mira Road has a good civic and social infrastructure. The existing roads are in the process of widening, while the local authority has built a skywalk near the railway station. The locality's drainage system is currently going through a positive change. There is a plan for setting up a new sewage treatment plant in the area as well as increasing water supply and upgrading the storm-water drain systems. There are also plans of slum treatment in the area. There are many educational institutions as well as banks, ATMs, commercial centres, parks, restaurants, business centres and a few malls. Cinemax is a popular multiplex in the area.

Hi Anirudh, Panvel is good for both end users as well as for the investors. The area is very well connected to several parts of MMR via the Mumbai Pune Expressway and Mumbai-Bangalore National Highway (NH-4). Some important highways that start here involve Sion-Panvel Expressway, NH-4B and NH-17. Apart from being well connected via roads and railways to different parts of MMR, Panvel is close to Kharghar, which is an important business and industrial area in Navi Mumbai. Taloje, another industrial node is also close to Panvel. It will soon be having the Navi Mumbai International Airport, giving a significant boost to the area.

Definitely, ongoing projects that have not received Completion Certificates so far have also been brought under the purview of the Bill and these projects need to be registered with the Regulator within 3 months, At the same time the Bill is not to allow promoters to change plans and structural designs without the consent of 2/3rd of consumers of a project.

Good Morning Vasanth, I think it can be accepted.......it will help both buyers and developer. But they are only discussing i don't know when are they going to implement it. Different party has sifferent view. Earlier, the NDA government had reduced it to 50% or less and allowed the state governments to lower the amount further. As per the AIADMK and Samajwadi Party states should be given the liberty to decide if they want to allow lower the percentage. Member from the Congress have given a difference of opinion proposing the said percentage be increased to 70%.

Well Leena, Ministry of Environment/State Environment Impact Assessment Authority (SEIAA)/State level expert Appraisal Committee approved the environment clearance certificate as well as the CRZ clearance whichever required.
Not only this Dev but also Airport Authority and Environment clearance takes much longer than required. Time limit should be prescribed for each approval and approving authorities should strictly maintain it.

Yes, agent is right. This locality palnned and developed by CIDCO. So, it is necessary to register your property under CIDCO. without CIDCO Transfer, no bank will give you a loan except DHFL and GIC and other Co operative bank. If you dont need a loan, you can go for it. You will have to pay CIDCO transfer when the convyeance is done.

Right Lokesh, The approval process has become indescribable lengthy, tedious, unpredictable and depends on the whims of individual officers. Getting approvals has become a major problem for builders and has increased the interest cost not just of the builders but also of consumers. No, From Vidhane Village to Ranjanpada Railway Station is about 23 kms. Don't buy such property which have no clear title. In future, you will be in great difficulty.

Hi Vipul, Apart from registration and stamp duty charges there are other charges which you have to pay are Transaction charges, Service tax, Value Added Tax (VAT) Capital gains tax to be borne out by the seller for a resale transaction.
It is always safe you pay these charges himself. Otherwise, you can pay it via agents but check the necessary details and receipt. Thanks....

Hi Vipul, These taxes are applicable only once during the lifetime of the property (i.e. first sale to the buyer at the underconstruction stage) and not applicable on subsequent sale after construction. I don't think you need to pay any ST or VAT at this resale stage.

You are right Dev, This project was launched 2 year back and stopped basically due to delay of MMRDA for rapprovals . The Western Heights is located is opposite to Gurudwara in 4 bungalows next to Metro Car Shed, in Andheri West. Adani bought this site from HDIL which was a commercial center at that location, then they got converted to residential land. This project is launched on 25.05.2014, after they got IOD approval. As per the developer the date of possession will be December'2017.

Hi Uday, I think one more time you should ask to the builder and try to find out the exact reason of delay. After that you can send him a notice via mail or via express post. If you are not getting the proper response then file complaint against builder before consumer forum for deficiency in service.

Hi Vinay, CIDCO has some guidelines for development permission which require multiple documents in absence of those documents CIDCO can refused the building proposal under Section-45(1) (iii) of the Maharashtra Regional and Town Planning Act-1966. I think there must be some legal issue with the project otherwise developer get the CC easily.

@Ares, It is happening because buyers are expecting of a price expectation in this weak market. It also shows that how buyers prefer to buy into completed projects. I want to clear here that the market has become largely end-userdriven and investors no longer park funds in residential real estate as the high returns was completely diminished.

True Deepankar, Dump yard redevelopment in Mumbai is very crucial. It is the only way to check prices in Mumbai is by increasing supply. There is no other magic to it. An average Indian would need to work for 3 centuries to pay for a luxury home in Mumbai.

Hi Suresh, Both the localities are good for investment point of view. But are entirely two different markets with different price ranges. As both the localities situated at a distance of 108 and 120 kms respectively from Mumbai. Comparatively Palghar is a growing market where rates are still reasonable and investment will bear good returns in the future. So in other words investing in Palghar can be a better proposition than investing in Boisar.
True Ravi, Palghar is easily accessible from the Mumbai-Ahmedabad National Highway (NH-8) and with the local railway line from Virar expected to extend upto Dahanu, connectivity to the locality is set to improve even more. This is expected to further boost real estate prices here.

The biggest issue faced by buyers is the disability of builders to deliver on time. This problem is specially critical in Delhi-NCR and MMR. In NCR, only 20% projects are running on time. The figure for MMR is 15%. People who invested with an aim of exiting with good gains in three four years are stuck. People have realised that in a bad situation getting out of real estate can be very difficult.
It is true Himangi, High interest cost is the another reason for poor sales. Buyers are waiting for a cut in home loan rates. However, if this was the reason, one would have seen a decline in demand for home loans. But according to Reserve Bank of India data, gross bank credit to the housing sector rose 17.4 % in the one year to 20% in February 2015. Bank home loan have been growing steadily at 18-20% CAGR over the past few years.

Yes, now, one has to provide permanent account number for any purchase or sale of Rs 1 lakh and above. In 2013, it was made mandatory for anyone buying an immovable property (other than agricultural land) exceeding Rs 50 lakh in value to deduct 1% TDS before paying the seller. Q: Dear Sir / Madam, I had approached Indiahomes in second half of 2012 for buying a flat in Malad/Goregaon viccinity and was presented with a detailed report regarding Shivshakti Enclave by Saaga Infra Projects. This was supposed to be a redevelopment project and bookings were open in Prelaunch stage. India homes representatives (Mr Prashant Zodge & Mr Mitesh) arranged a site visit and then negotiations with the developer thereafter. Being new to Mumbai, I hardly knew about the developer but was well aware that Indiahomes verified project would be a safe investment. Personnel from both - the developer and India homes followed up for payments and the flat was booked in 100% white transaction (Flat E-101). Alas my hopes were dashed when I followed up back with both parties regarding progress status and the project till date has not even started as yet and the old society still stands as it is. To my surprise both Indiahomes and Saaga Infra Projects refused to let me know updated status just avoiding my calls or requests for a refund. The site office has since been closed and even the main office of the developer has shifted once. Mr. Uday Surve - a supposedly reputed name in the industry has refused to meet even once in my follow up for the last 2 years ans so has the staff from India Homes simply flashing 'Project Unavailable' - Status on their website. Any number of enquires for this project are not retured with calls / sms to their office. I feel swindled of my hard earned money and pity the cheap marketing techniques employed by Indiahomes without checking background information on the project which have left buyers like my without a shelter in Mumbai. I am thinking of initiating legal action / consumer court complaint against both Saaga Infra Projects & India homes for cheating and fraud. Hope this complaint gets noticed and long delayed feedback is given. kind regards

Hi Miheer, Really very sad to hear from you. Any person can file a complaint against the builder, developer, broker with the consumer court under the following circumstances: If the developers or the builders did not deliver the house within the agreed time limit. If time limit not mentioned, it is assumed that the construction will be finished within maximum of 3 years from the date of start of work. The person should let the builder know about the grievance and send a notice to the builder in writing.
I think Roshini is right!!! If your builder delays the possession, you can claim interest on the payment made till date. Under the Maharashtra Ownership of Flats Act, 1963, the developer is liable to refund the amounts received, with 9% simple interest. The interest can range between 9 to 18%. Also, the interest is payable only on the amount that be proved as paid to the developer.

Hi, Service tax is payable only after handing over the possession of the property in question. In budget 2015-16, it was proposed that a homebuyer will pay a service tax of 14% while buying a property that’s under construction instead of the current 12.36%.
Rakshit is right. Service tax is applicable on almost all services that a consumer avails, including buying an under-construction property. This is so because, in case of an under-construction property, the developer is deemed to be the provider of construction services to the homebuyer, and hence service tax is charged on the cost of construction. It is not charged on the entire value of the property but only to the extent of cost of construction. This means that cost of land is excluded.

Hi Vaishali, All the projects in the area (Panve, New Panvel, Powai) are delayed due to Naina project. There are around 180 project that are are under hold. Naina plan are now approved by cidco & sent to CM office for further approval. If it get approved from CM office, it will take 1 yr to start the project of any builder.
Yes, all the projects in this area are delayed by 1-3 yrs. and still most of the projects didn't get approval from CIDCO. You can check online also, there are lot's of bad reviews on delay possession and delay approval process. So, before buying property in those localities, take all the due diligence. Otherwise your hard earned money may get stuck.

You will only mention positive points no negative points for ur stuff. Real Estate portals also works with the help of developers. So, no real estate portals will give you the negatives points of any projects or you can say that they will always say, it is a good project and the developers is renowned in real estate market of Mumbai. So, better visit the project site ask the slaes guy or representative to show you the required legal documents of the project, ask in the neighborhood or the buyers of that project and then proceed.

Q: I have booked a flat in an under-construction redevelopment project in Mumbai. Its a 17 floor tower but at the time of booking they had CC only till 12th floor and they had applied CC again for further floors. My flat is on 4th floor, its been almost 7 months but they havent still got the CC while the construction work is stalled as 12th slab is completed. Just last month builder said, he has got a new IoD for all floors and CC will e issued soon. My query is, does builder get CC in parts or there might be some issue with the permission for upper floors? And does IoD needs to be reapplied because he already had the IoD earlier when he started the construction.

Yes, the certificate should contain all the required details, including the identification of the land, the location, if the building has met all the standards of safety and regulation, the distance from the road, distance from surrounding buildings, height and other criteria set by the Municipal authorities, along with the building plan. In short, the completion certificate guarantees that the building has not violated any rule in that locality.
It is true Abhi, A buyer should not get possession of a house or building without a completion certificate, which also sets into motion other compulsories such as the payment of property tax and housing loans. Your building may demolished anytime if builder has no CC and some amenities such as water and electricity are also stopped by the Municipal Corporation.

Hello Sidhesh, I think your builder can give you the better explanation on it. But for your knowledge, i would like to say that earlier, from 1st June till 30th June 2017, 1 per cent VAT has be collected only on payments received and not flat 1 per cent on Agreement value. From 1st July VAT & Service Tax 1 per cent plus 4.5 per cent shall be replaced by GST 12 per cent. Since taxation is increasing by 6.5 per cent the total costing is going to increase after 1st July. The effective tax after set off, tax credit depends on the stage of construction. In short a project in early stages could have better tax benefit while a project at completion stage will have lesser tax benefit. Accordingly developers will decide upon passing on this benefit to the customers. Q: RERA will bring relief to the buyers only and only if the original act is implemented by various states without dilution. Ground reality is that most of the state govts are diluting the provisions of RERA to favor the powerful builders lobby who traditionally share the loot with the politicians.

You are right Priya...... Clause 14(3) is acting as a warranty. Warranties will make buyers and investors feel secure, as it makes it mandatory for developers to rectify any construction defects that may be noticed, even after possession has been handed over.
Some of the important compliances, which once will come into power will change face of the Indian Real Estate Market. These are 1) Informing allottees about any minor addition or alteration, 2) Increased assertion on the timely completion of projects and delivery to the consumer, 3) No launch or advertisement before registration with RERA, 4) An increase in the quality of construction due to a defect liability period of five years, 5) Consent of 2/3rd allottees about any other addition or alteration, 6) Sharing information project plan, layout, government approvals, land title status, sub-contractors, 7) Formation of RWA within specified time or 3 months after majority of units have been sold and 8) Consent of 2/3rd allottees for transferring majority rights to 3rd party.
