Autonomy to be granted to housing societies
Mumbai- The governor of Maharashtra signed the long awaited 97th constitutional amendment which is expected to give the housing society committees autonomy.
Although there have been various mixed responses from the activists and property lawyers, the powers of Deputy Registrars will be minimized with societies being granted the independence they have been craving for.
The amendment article was introduced as 43B and the state will be promoting the voluntary formation, the democratic control, autonomous functioning and professional management of co-operative societies as per the policies in the Act of Parliament.
As per a government official, the amendment was passed by the governor and will be uploaded on their website very soon. The Deputy registrars will no longer handle or resolve the disputes within housing societies as per the amendment. Instead the co-operative court will handle the matters.
According to an activist, various election officers will be appointed to overlook the office bearers elections within a housing committee completing a term officially set as five years.
There were other changes which were made like including the mandatory audit report of a co-operative society’s accounts within six months end of the financial year. A property expert advocate stated that the co-operative movement has been successful due to the absence of any other alternative. The amendment will further fetch mechanism to societies which can function independently.
He further focused on the advantages of the amendment and said that there will be increased transparency in the elections as that is a major problem. Perhaps along with advantages, the amendment also has disadvantages with the matters going to the co-operative court as the courts are already having various cases. With all the matters going to the court, it will result in the backlog of cases.
The number of housing societies in Maharashtra, Mumbai and Vashi are 80,000, 30,000 and 20,000 leading to an encounter o approved changes.
