Allahabad HC stayed Development Work in Dadri
A notification for acquisition of the land (under Section 4 along with 17 (1) of the Land Acquisition Act) was issued on November 19, 2008, for planned industrial development of Dadri. Later, notification under Section 6 of the Act was issued on March 23, 2009.
A division bench of the Allahabad High Court on Tuesday stayed development work on 4.93 hectares of land in Barandi Chakrasenpur village in Dadri tehsil of Gautam Budh Nagar. A bench of Justice Sunil Ambwani and Justice Pankaj Mithal also directed the Greater Noida Authority and the state government to file counter-affidavit in the case by September 27, the next date of hearing.
The farmers alleged that “though there was no urgency to acquire the land, notification for the same was issued without application of mind under the urgency clause”. They further prayed that as they are still in physical possession of the land, “there should be no interference in this peaceful possession”.
While challenging the notification for acquisition of their land, petitioners Ram Singh and others of Barandi Chakrasenpur stated in the writ petition that they are ‘bhumidhar’ with transferable rights and possess plot number 230 (4.93 hectares) in the said village. They have also constructed houses on the plot which is being used as ‘abadi’ land, they added.
