Bombay HC asks HDIL to hand over possession of Kurla’s Premier Residency flats
Housing Development & Infrastructure Ltd has been asked by the High Court to consider handing over possession of ready flats at its Premier Residency project at Kurla in Mumbai. The Bombay high Court suggested that the lawyers representing the developer and home buyers should try for an out of-court settlement.
Aejaz Saiyed, who has bought a house in the project, filed the petition in the court. Around 60 residents have complained to the police, accusing the directors of cheating and not handing over possession of flats despite receiving the full payment. Saiyed requested to the court to consider converting petition into a public interest litigation considering the number of affected homebuyers.
The developer, however, claims that some customers have defaulted and have not paid the interest on delayed installments. They further inform that over 289 flats have been handed over to the customers of Kurla Premier Residences so far and interest letters have been issued to customers, who have defaulted on the scheduled payments.
