Bombay HC rejects CM’s discretionary housing quota
The Bombay High Court rejected Maharashtra Chief Minister’s discretionary housing quota citing that the allotments of flats in this quota were illegal. The court added all the policies of the state government regarding this quota are not up to the mark.
The court stopped the state government from allotting the 2 percent of the Maharashtra Housing and Area Development Authority (MHADA) flats and 5 per cent flats on private land under the Urban Ceiling Land Act.
Mr. Uday Warunjikar, who represented petitioner Manohar Bait, says that this is the first time the court rejected the power of chief minister. The court found the methods used by the state government in the allotment of flats are illegal.
The court clarifies that the statement of the allotment of flats under the quota prior to its decision would be determined in another criminal PIL filed by activist Ketan Tirodkar.
