Chetak Society files petition against Sandhu

Mumbai- Sandhu Palace, the tallest tower on Pali Hill, which is supposed to be the most expensive controversial residential building of Bandra, is up for sale.

In October, Sandhu Developers, has put the property for sale at a price of $147 million, or around Rs 800 crore. More than Rs 60,000 per sq ft, was being quoted for the property and several flats have already been sold to NRIs at more than Rs 35 crore each. Around 19 of total 48 flats have been sold by the builder.

Chetak Cooperative Housing Society (Manju Mahal), which had taken the builder to court for many violations, saw the advertisement last week and quickly moved a contempt of court petition against the builder. It said that the builder made efforts to dispose of the property, which had been “constructed by violating rules, regulations and applicable laws by making misrepresentations before the concerned authorities”. The Bombay High Court has ordered for a status quo.

Despite the case was going on in court, the developer tried to create third-party rights by selling off the property. Kanwarjeet Singh Sandhu, the builder, said that he paid the society Rs 8.10 crore as part of the agreement, but it was still looking for a further financial settlement.

According to Chetak’s petition, Sandhu and the Brihanmumbai Municipal Corporation (BMC) conspired to increase floor space index (FSI) of the building. The society had allowed three of its four plots to acquire development rights but the builder illegally obtained the rights of the fourth plot, which was not part of the agreement.

In the society’s petition, along with the developer, the municipality’s commissioner, deputy commissioner, executive engineer and deputy engineer of Building Proposal Department, Bandra too have been made respondents.
