DCR Violation against a Builder.
The Gulmohur Residents Association, in its legal notice to the company, said that the building was constructed in violation of various Development Control Regulations (DCR) and has asked it to desist from selling it to a third party till the floor space index issue is resolved.
Vibhav Krishna, advocate for the association, reported saying, “the legal notice was issued following a public notice from the advocates of the prospective buyer calling for objections within a fortnight as they were negotiating the sale and we wanted the objections of our client in public interest to be duly recorded.”
Nayan Shah of Mayfair Housing reported saying, the notice mentioned that the association was yet to complain to the BMC. “What proof do they have of any illegal construction or that any illegality will be committed in future? Instead of sending a notice and making allegations, the association should have approached us and we would have gladly shown them around the premises to verify for themselves if there were any violations.”
