Enforcement of Rules and Stringent Action against Illegal Buildings in T Nagar
In 2007, CMDA and corporation officials conducted a survey of commercial multistoried buildings on North Usman Road, South Usman Road, Ranganathan Street, GN Chetty Road, Thyagaraya Road and Venkatanarayana Road in T Nagar, Chennai and found that 64 had violated norms and didn’t file applications under any regularisation scheme. “Many of them had an FSI of 9 against the authorized 1.5. The city is likely to soon witness strict enforcement of building rules and stringent action, including demolition of unauthorised multi storeyed commercial buildings. The monitoring committee sent demolition to 48 commercial multistoried buildings for violations and show cause notices to for 42 more multi-storied buildings. The monitoring committee appointed by the Madras high court for the purpose is scheduled to meet on Friday. The committee had earlier identified 154 multi storeyed commercial buildings, including 64 in T Nagar, for demolition.
The meet assumes significance against the backdrop of the Supreme Court recently vacating its order of status quo on the Madras high court order that struck down the previous government’s regularisation schemes for unauthorised buildings. Over the years, along with rapid real estate development the city also saw large-scale violations of development control rules. Builders violated the plan permits sanctioned by the CMDA and ignored norms for set back, parking, fire safety and floor space index.
“However, the monitoring committee became dysfunctional, after the previous DMK regime promulgated an ordinance on July 27, 2007 prohibiting demolition,” said M G Devasahayam, a member of the monitoring committee. The ordinance had been extended till July 27, 2011. “Following the Supreme Court’s order, the committee will perform the task assigned by the high court,” Devasahayam added.
In its 2006 order, the high court wanted the committee to first take up commercial multi-storied buildings — those with more than four floors. A building, whose construction is deemed illegal, should be demolished as should an extra floor put up illegally, it said.
The committee was asked to identify builders of illegal multi-storied buildings and special buildings, for imposition of heavy penalties which would then be used to compensate the unwary buyers. The panel was to ignore structures built before February 1999, when the first regularisation scheme was introduced.
