Extra FSI approved for 2000 redevelopment projects in Mumbai
Bombay High Court has recently given green signal for additional floor space index (FSI) for around 2,200 redevelopment projects in Mumbai.
The only condition that was kept forward by the government was struck down by the bench. The condition was to grant extra FSI in case of ongoing redevelopment schemes for old cessed buildings.
Earlier in May 2011, when the development control (DC) regulations were modified, it was made a provision of increasing FSI for such redevelopment projects from 2.5 to 3.
However, the state government had implied the rule only on ongoing schemes and can only be availed if the construction of the building had not progressed beyond the plinth stage.
As per a Mhada official, there were around 2,200 ongoing projects to be redeveloped. Furthermore, a developer had challenged the condition stating that it was unconstitutional.
The High Court has alleged that extra FSI can only be availed by ongoing incomplete redevelopment projects whose complete occupation certificate has not been granted. The structural stability certificate has to be submitted by a certified licensed engineer.
Earlier, 2.5 FSI had been granted for Pune and Pimpri-Chinchwad but the rules for the same were yet to be finalised. The Pune division of Mhada has been forced to put its redevelopment projects on hold.
MHADA which was established in 1977 to offer good housing opportunities in Maharashtra aims at giving additional built-up area and amenities for residents’ houses at a certain cost.
The main reason for the demand for additional FSI is to provide more affordable properties in Pune for all. For example, after the grant, a plot of 1000 sq ft can have construction area 2.5 times the plot area. Also, those staying in small hutments in housing colonies will get extra amenities and facilities.
