Govt buys more time from SC to establish up green regulator
The government turns toward SC to buy 6 months time to establish an independent environment regulator which will check the projects requiring the green clearance and apply conditions for approval and impose fine on defaulters. The government also concluded that it requires minimum 6 months to complete the process.
The ministry of environment and forests (MoEF) says that it has distributed the note including the functions and broad structure of the proposed regulator/authority to the concerned ministries/departments for comments and the same will be sent for cabinet for approval.
While the cabinet goes through the proposal, MoEF proposes that the regulator may have the work of overseeing the process of accredition of Environment Impact Assessment (EIA).
As per the ministry the details of human requirements of the regulator, both at center and state level will worked out after the cabinet nod and then notification will be issued after getting it vetted by the law ministry.
The ministry also says that the proposed regulator cannot be given authority to impose fine on the polluters as this authority is given only after getting court order. The act does not provide for the civil penalty that can be imposed by the government or any other authority.
