HC: BMC Mumbai should take Precautions during Construction of High Rises
Bombay High Court on Monday while asking Brihanmumbai Municipal Corporation to ensure that precautions are taken by developers during construction of high rises referred to a recent incident when a coconut tree in a municipal garden killed a top official of a private equity firm.
“Trees are falling in your gardens. People are dying,” remarked Justice Majmudar, referring to the death of managing director Ved Prakash Arya in a municipal garden in Andheri on August 25. The court was informed that construction activity was being carried out in a manner which exposes the area to health hazards like malaria.
A division bench of Justice P B Majmudar and Justice R M Sawant was hearing a petition filed by Walkeshwar resident Pradip Vakil, his wife Sandhya, and daughter Jahnvi against a 12-storeyed construction by Lakshachandi Columbia Developers adjacent to their building, for causing inconvenience and being a health hazard. The judges have asked BMC advocate Vidya Gharpure to have the area inspected and file an affidavit on the situation.
