HC defines redevelopment rules for general buildings, surrounded by heritage
The Bombay high court, on Tuesday asked BMC to clarify its view on the redevelopment of common buildingsĀ coming under a proposed heritage precinct.
Hearing a petition by Chembur Citizens’ Forum, representing approximately 500 buildings opposing their heritage status, was a bench of Chief Justice Mohit Shah and Justice M S Sanklecha. As per the petition, 92 percent structure does not come in category of heritage. In spite of that, the civic chief is not focusing on the redevelopment application coming to him because of that an NOC of Mumbai Heritage Conservation Committee was required before accepting any proposal for redevelopment of building on recommended heritage list.
The forum’s advocates, Venkatesh Dhond and Sanjay Kadam, claim that there was very little heritage features left in Chembur. They also explained after going through 2007 report that many buildings have been destroyed and rebuilt over the years. They also claimed that the heritage panel’s approval was required for the redevelopment of grade 1 and 2 structure.
Mr. Dhond also claimed that there are no rules for the proposed Chembur heritage precinct. He also added that the committee going to identify large patch of lands as heritage precincts without rules. The committee have mixed situation where it is a precinct but there are no rules for that.
