New Supreme Court bench to hear Sahara case on May 19
The new bench, which was constituted by the Supreme Court to hear the Sahara case, is scheduled to begin proceedings in the matter today, May 19.
The justices that comprise the new Supreme Court bench for hearing the Sahara case include justices TS Thakur and AK Sikri. The constitution of the new bench was necessitated when JS Khehar recused himself from hearing the Sahara case.
Since 2012, the Sahara case as being by a bench comprising Justice KS Radhakrishnan and Justice Khehar. However, with Justice Radhakrishnan having retired on May 14, and Justice Khehar having recused himself from the case, the new bench to hear the Sahara case was constituted by the Chief Justice of India, RM Lodha.
Justice Radhakrishnan had recently said at his farewell event that the hearing of the Sahara case has put him as well as his family under “unimaginable pressure and tension.”
In a May 6 judgment, Justices Radhakrishnan and Khehar had upheld the order under which Sahara chief Subrata Roy has been jailed since March 4, for failure to refund an whopping amount of more than R20,000 crore to depositors.
With the court asking Roy to make a new proposal for paying R10,000 crore for getting bail, Justices Radhakrishnan and Khehar had also turned down Roy’s claims that rules of natural justice were being overlooked during the hearing of the case.
