High Court orders builder to pay penalty for violating building norms
Gurgaon- Over 500 flats in Ardee City have been included in the list of partial demolition order issued by the Punjab and Haryana High Court.
The Court order directs the builders to remove the structural violations and pay penalty within the next six months. The order has been receiving mixed reaction from the residents.
The gated community comprises of 1,500 flats built over a decade ago by a private developer. In about 500 units, the builder constructed extra rooms, floors and balcony which are in gross violation of the building plan, and sold the same to innocent buyers.
The houses in the list are built in over 10 percent structural violations. Earlier, as per the DTCP norms, 10% violations in houses were compoundable which meant that the owner can get occupation certificates by paying some penalty.
Later, the department of town and country planning (DTCP) refused to give occupation certificates to 500 flat buyers, citing violation of construction norms. Now, the high court has directed the DCTP to allow occupation to buyers after rectifying the violation of construction norms. The court has asked the DTCP to remove only minor portions so that the building structure is not affected. It has clearly stated that the builder will have to pay penalty for houses where the violations are beyond 10%.
The compounding charges will be calculated as per the slab of the DTCP and beyond that the penalty has to be paid by the builder. For the removal of the structural violations the court has directed the DTCP to remove only those portions that do not cause serious damage to the entire three-storey building structure.
Many of the flat owners have welcomed the court order. An owner said that the court has rightly made builders accountable for the violations. Now the builder only has to pay penalty and applicable compounding charges and not the house owners.
