Q: Hello, I purchased new flat (under construction flat) in Bangalore in June 2011. Basic cost of my flat is 30Lakcs. And 1.5 Lacks for Car Parking. Total basic cost is 31.5 Lacks. My Builder charged me 5% of VAT on 31.5 Lacks (Basic Cost of Flat + Car Parking Amount). My Builder also charged me 2.7% of Service Tax on 31.5 Lacks (Basic Cost of Flat + Car Parking Amount). Do I need pay both VAT and Service Tax to my builder? Do I need to pay VAT? If yes, as per Govt. norms how VAT I need to pay to my builder? As per Govt. norms how much Service Tax I need to pay to my builder? Please advise. Thanks, Venkat.

Currently the rate per sqft going on is Rs 3300 and the project will have all the modern amenities. Amenities provided are as follows: Adults & kids swimming pool, Tennis court, Basket ball court, Party lawns, Fountains, Open Amphitheater, Landscaped gardens, Central water cascade, Toddlers park, Gazebos and much more.

Q: Hi, I have booked an apartment in Electronic city, Bangalore. The flat is under construction and will be available for possession during feb 2013. The builder has given us the cost break up which has Rs.2,62,000.00 as service tax and VAT on the property which cost Rs.32Lakhs (basic cost + car parking). Kindly clarify me, what is the calculation for service tax and vat? Also pls clarify me what is the need for two separate agreement, say sale agreement and construction agreement? Now my builder is telling me that he will be giving me only one agreement. Kindly advice me on this. your clarification will be much helpful for me. Kindly help me. Thanks Rona

As as far i know VAT s 4% and Service tax is approx 5% of the total cost of the flat (Unit Price, Car Parking, Power/Water, Generator, Club etc whatever you pay to the builder). This doesnot include maintaince.

E-City Town is known to be approved by banks like LIC, HDFC, State Bank of India, Axis and ICICI. The project site is quite close to most of the IT companies at Electronic city, Industries at Bommasandra Industrial area and easily accessible to most of the hospitals on Hosur road. There is also a proposed plan for Neo Mall near the project site.

Q: I recently booked an under-construction apartment (95% work done) of super built up area 970 Sqft. in Bangalore. The builder sales guy calculated Service Tax (12.36%) on 25% of construction value ( Flat Cost + Car Parking - Land Cost). But after booking during agreement he is saying that norms has changed now and service tax will be charged at 40% of the construction value. He is saying that norms changed since 1-Jul-12 however they did not get confirmation and now only got the confirmation. Please suggest what is current service tax rule is. He is making 2 agreements (1 for land and another for construction). And he did not reveal the modified service tax till I paid booking amount. Also he is asking for 4% VAT on Construction Value. Is it correct and is saying that later on he may charge service tax on maintenance cost as well. Please advise.

1) The Akrama Sakrama Rule which mentions of regularizing setback (minimum distance between the building and the boundary and between two buildings) and Floor Area Ratio violations, but there is no talk about violation in car parking space violation. What are the house owners with parking space violation supposed to do? 2) Akrama Sakrama Rules allow the regularization of residential buildings with deviation upto 50 per cent and non-residential buildings with deviation upto 25 per cent. Majority of the small houses in Bangalore have deviation exceeding 50 per cent, whereas most of the high-rise buildings have less than 50 per cent deviation. So who will reap the benefit out of the scheme? 3) According to the rule, application related to land use violation shall be forwarded to the concern Urban Development Authority or Planning Authority for approval. There are many urban local bodies in the state where Urban Development Authority or Planning Authority does not exist at all.

I feel apartment buildings are inflexible property and there is only certain limit of appreciation it can generate over time but for long term I feel purchasing land is a good option.
The price appreciation for plots are faster than that of ready-made properties. Moreover, a plot will never get affected by time but a building structure can get dilapidated over the time. :) :)

Q: I would like to share this concern with all those who have booked a Sobha Aspire / Elite apartment. I have booked a Sobha Aspire flat . I find the makes of electrical fittings / faucets / door fittings they have actually used is was below the expectation & image of Sobha as a premium builder. I was shocked to notice that the electrical switches were of "Salzer" make as against reputed makes like Crabtree , Clipsal etc.. The MDB & switchgear is from Indo asian, one of the cheapest in the market as against reputed makes like Legrand, Merlin Gerin, Hager etc.. The door locks & handles were of Hafele make (German) in the model flat. Here they have used Godrej. Similiarly, the faucets are of Parryware as against Jaquar. Parryware is no match to Jaquar when it comes to product quality. I would request all like minded people to come together so that we jointly take up the matter with Sobha to do the necessary changes. Q: *I have finalized a 3BHK flat in Purnima classic which is JV between land owner and the developer in Basapura near Hosa road junction near Concorde Midway city, which is New but its 1 year old flat with built up area of 1719Sft. The apartment society had not been formed yet. *Builder quoting 3k/sft(negotiable). Which makes it RS.51,57,000 basic cost for just the flat. *But he is charging additional 2 lakhs for parking, *Deposits 2,57,850(Rs150XSFT), *VAT & TAX @8%(Basic cost+Car parking +deposits=4,49,188), *Registration(1500rs X AREA+ Car Parking X 6.6%=1,78,035) *So the Total cost of the flat is coming up to Rs.63,03,115. which is 11,46,115 extra from basic cost of the flat. Can any one plz advice me on this additional costs and taxes are legitimate? And what are the things I should point out while negotiating with the builder? What are the Usual additional costs and taxes apart from the basic price of the Flat? Any advice is highly appreciated. Thank you.

I heard that Electronic Phase II is not so well developed so will it be a good idea to invest in this area.
If you are looking for a long term investment you can consider EC Phase 2 as this area will take time for development and till now no reputed builders have come up with their project. EC Phase II is getting developed slowly and the real estate is also booming. Once the proposed PRR gets functional you can expect a good return from Phase II.

See, i think there was plan B also recommended by the authority, that they will come up with 400 houses in Gottigere which will be built under the Ashraya scheme. But if this was to happen then Bannerghatta National Park would have been in danger as the place will cover up that also and raising wildlife concerns forced the authority to drop the plan. There was no other alternative land.
But i guess this matter was suppose to get resolved long back.... just because of the delay of the plan is yet hanging!!!!

They are charging Rs 1 lacs as the booking amount and they will give 15 days time for verifying all the documents related to the project. They are not even taking any kind of cancellation charges as well. Banks like LIC and SBI is offering home loan for this project.

Previous records state that east Bangalore was home to a number of manufacturing units which has played a special role in the growth of the region. The establishment of EPIP Zone along with ITPB, set off the residential and subsequent commercial growth in the region. Proximity to ORR, together with availability of huge graded office space lured a number of IT/ITes entities in the eastern region. This, eventually, fuelled the need for residential real estate growth in the region.
According to real estate experts, east Bangalore area offer the best returns in near future. Many developers are targeting these areas and the property prices are expected to rise. :) :) Cheers

Developers jump on the villa bandwagon due to higher profitability margins. I completely agree with Arunabha and I want to add the benefits of monolithic construction: 1) Commonly seen problems of Leakage/ Seepage will not be there, 99.9%.If occurs, would be spotted the very same day and can be stopped very easily. Seepage on the outer wall cannot penetrate to the inner wall and vice-versa. 2) Thermal Insulation:Since these walls contain a layer of High quality insulation material it will allow: Heat Retention within house in winters. Cool retention within house in summers. Saving electricity cost up to 80% of air conditioning & heating electricity cost 3) Sound Insulation:Since these walls contain a layer of high quality insulation material it will NOT allow (absorb almost 90% of the sound) sound to pass through it and act as a barrier in between. Hey Hardik, You are right the project offers 2 and 2.5 bhk apartments with size ranging from 975 sqft to 1285 sqft. You just have to pay Rs 4 lakhs to book an apartment. The price of the apartment starts from Rs 29 lakhs on wards.

My comments to replies
Developers in Bangalore do not construct apartments as per the guidelines given by the state government. The Government does not want to demolish such illegal construction and have come out with this scheme to regularize it by levying fine and penalty. It is called AKRAMA-SAKRAMA. So it was home buyers who are expected to get benefited.
There is not much difference between 2007 rules and new rules. The new Akrama Sakrama rules published in May 2014 has lot of loopholes and it need to be fixed at the earliest.

Majority of the small houses in Bangalore have deviation exceeding 50 per cent, whereas most of the high-rise buildings have less than 50 per cent deviation. So who will reap the benefit out of the scheme? 3) According to the rule, application related to land use violation shall be forwarded to the concern Urban Development Authority or Planning Authority for clearance. There are several urban local bodies in the state where Urban Development Authority or Planning Authority does not exist at all. In that case which authority shall scrutinize the application and give clearance for regulation?

A 2bhk with 1050 sqft will cost you around rs 29.25 lakhs excluding registrations and VAT. There will be a total of 56 units with a combination of 2 and 3 bhk configuration. The expected possession is by end of 2015. For water supply they are going to install borewell and also going to provide corporation water. Cauvery water provision is there.

Akshayanagar is one of the most fast developing and peaceful destinations located in Bangalore. The region has become quite active in the infrastructure radar due to various developments which includes NICE Road that has smoothen the connectivity with Electronics City, Bannerghatta Road and Mysore Road. The locality has all the basic establishments nearby.

Q: Hello Experts, I booked an under construction flat in Nov 2015 and for some reason agreement got executed in June 2016. The overall cost of construction is 50 Lac and in Dec 2015, only 10% of the construction was completely , hence the VAT applicable amount was 45 Lac as given to me in the agreement. Now should the VAT applicable amount be same (after 8 months) when the construction has progressed more than 10%. In a Nutshell, the VAt applicable on construction is applicable as per date of booking or date of execution of Agreement ? Best Regards!!

Q: Booked property with RMZ Latitude paying 30% upfront amount of in May 2014 at RMZ Latitude Project in Bangalore , While, in terms of the Agreement to Sell, the Apartment was to be completed and handed over to us by December 2014, In March 2016 I requested for refund of money with multiple follow-ups, the refund clause is mentioned in their agreement in case they could not able to deliver the property on time, after multiple follow-ups I have received no official response from them on my refund. Have gone thru a huge amount of personal harassment and heavy personal expenses during this entire process as I am based out of Mumbai now and need to travel many time to Bangalore followup purpose, after sending many mails to their senior leadership & reminders I normally did not receive any response from RMZ Homes for any status of my refund. Their sale agreement talks about the refund the amount in case customer cancel the project but they are not even following which is a part of contractual understanding. My biggest frustration is for their senior leadership who has no fundamental value to be responsible to their customers, just putting flamboyant outlook and flashy cloth does not make anybody as it is required to be customer-centric and the customer should feel the same experience when they book the property till the customers get the possession. I hope my above experience would help many people in their decision going forward.

Hi Subrato, First of all you have to send a final mail to the builder and ask for the immediate possession. If you are not getting any positive response this time, then take the hard copy of the mail along with the required documents and make a complain to the RERA authority. The process of converting B Khata to A khata B Khata can be converted to A khata by paying betterment charges to BBMP, however, there are a lot of conditions attached to it. Q: I am buying a investor flat. The flat is still not registered till now and I will be first owner. The flat is ready for the last 3 years. My broker is saying that I need to pay the property tax and the previous owner can't pay the property tax as it is not registered. Is this correct that until the property is registered the tax cannot be payed? Can the investor pay the tax for the flat that is not yet registered?

No, you do not have to pay property tax. In civic body or registrar office record, the previous owner is liable for paying property tax or other expense till the property is registered in the name of a new name.
