BMC to demolish illegal structures rebuilt

Bombay High Court has recently directed the Brihanmumbai Municipal Corporation (BMC) to raze the illegal structures which have been rebuilt again.

This came into light after a housing society in Santa Cruz filed a petition against an unauthorized construction in front of a division bench. Hearing the case, the two Judges involved reminded the civic body its responsibility to keep public land free of encroachers.

The housing society, Omkar cooperative society at Anand Nagar in Santa Cruz had filed a case over an illegal structure which had come up on the approach road to the housing complex. It was a failure on the part of the BMC and Mhada to take action.

The illegal structure was demolished in 2009. However, the corporation failed to notice the structure which has come up again in the same locality. The court said that the civic body can not walk away from its responsibility if the structure come up again.

Replying to the above case, BMC claimed that MHADA owns the property and they have failed to furnish any details. Furthermore, the building’s owner claimed that the land is under civil dispute.

This is not the first time court has directed BMC for something. Last month, the civic body was rammed by the court for the same kind of approach. The court has also asked BMC to set up a redressal forum to fight against such encroachments.

BMC has also been directed to not wait for an FIR report for such cases and directly take action against such illegal structures.
