Builder to pay Rs 1 lakh for not giving Flats to Buyers
Mumbai-based RNA Builders (NG) have to pay Rs 1 lakh fine for the failure in handing over the flats to their buyers.
The forum National Consumer Disputes Redressal Commission then ordered the builder to return the money along with compensation.The complainants, however, were aggrieved at this ruling as they did not want the money, but the possession of flats. They then filed an appeal in the Maharashtra Consumer Disputes Redressal Commission to hand over possession instead of refunding the money received.
Now the builders have to pay only Rs 1 lakh fine to the two flat buyers who in 2007 had purchased two flats on fourth floor in the building, NG Vikas, in Mira Road and each flat measured 379.88 sq ft, but never received possession. The flats cost Rs 8.24 lakh each. While Rs 25,000 is to be given to each of the two buyers, Kalikant Mishra and Sujit Mishra, the rest will be deposited in the name of Consumer Legal Aid Account. The builders have also been ordered to give possession of the flats to the complainants after receiving the outstanding amount.
The builder has made the flat buyers run from one forum to another during the last four years so that they don’t have a roof over their heads and he can go on enjoying their money without any hindrance. “Real estate prices have been increased tremendously and the complainants will not be able to purchase a flat at the same rate that was prevalent in 2006,” the state commission said.
