Karnataka government accused by CAG for illegally denotifying land
Belgaum- The government of Karnataka has been strictly accused by the Comptroller & Auditor General of India (CAG) for illegally denotifying land which was acquired by the Bangalore Development Authority (BDA).
The report, Denotification of Land by Government and Allotment of Sites by BDA, containing all details regarding how the rules and court orders were jeered by chief ministers, BDA and the officials, has been submitted in the legislature.
In the past five years, the denotification of 212.39 acres (126 cases) of land had been done in defiance of the law. The government, especially which was headed by former chief minister B S Yeddyurappa, had denotified majority of acquired lands including litigant lands, developed lands and land parcels reserved for group housing.
Former CMs N Dharam Singh, HD Kumaraswamy and D V Sadananda Gowda are also on the list. There are even cases where land parcels were returned to the original landowners, although the authority had formed sites and distributed them.
The government does not acquire any power to denotify a land which had once been notified for land development for public purpose. Even though after acquiring, if the land is no more required for public purpose, it cannot be denotified. But in certain circumstances, if the land has to be denotified, then it has to be approved by the denotification committee. But the CMs had skipped this rule too.
34,527 acres of land have been notified to form 54 layouts between June 1948 to February 2010. By April 2012, the possession was taken only of 19,049.02 acres (44%). The land is supposed to be taken for possession two years from the date of final notification. However, huge delay in taking possession of the land led to prolonged land denotifications.
