No construction activities between 10 pm to 6 am: High Court
Bangalore- The Karnataka High Court, has banned all construction related activities from 10 pm to 6 am in the city.
Relaxing its order passed on 6th December, in which the court had directed builders to totally ban all construction or allied activities from 6 pm to 8 am, it has permitted the builders to carry out 11 construction related activities work from 6 am to 8 am and 6 pm. to 10 pm.
A Division Bench comprising Chief Justice Vikramajit Sen and Justice B.V. Nagarathna, passed the order following a hearing of a public interest litigation (PIL) petition filed against permission granted to construct Sobha Dew Flowers, an apartment in J.P. Nagar here.
The builders are allowed to carry out 11 construction allied activities including Earth work, Block work, Concreting work, Finishing work, Painting, Landscaping, only between 6 am to 8 am and 6 pm to 10 pm.
The Bench granted permission following the undertaking of Confederation of Real Estate Developers’ Associations of India’s (CREDAI), Bangalore, of issuing circular/code of ethics to all its members and following measures to educate them to use construction equipment that cause no or very less noise.
It had been difficult for builders in Bangalore to carry out works only between 8 am and 6 pm. In order to overcome this problem, the CREDAI sought to alter the restrictions posed.
The Bench announced that the rules and regulations will apply to all the persons involved in construction activities, and not only the CREDAI members.
