RWA asks Ansal to hand over common areas with maintenance
Gurgaon: Reputed real estate developer, Ansal API has offered the administration of Sushant Apartments to its local residents’ welfare association (RWA) while the RWA is reluctant to accept the offer.
The RWA said that Ansal is not ready to hand over the common areas such as park, club, roofs, lifts and security to the association. So the RWA has decided not to take the responsibility of maintenance without the assets.
At present, a facility management firm named Profac is taking care of the maintenance-cum-security of Sushant Apartments.
Meanwhile, the developer has alleged that he is ready to transfer assets to the RWA along with the maintenance of the locality. Ansal API’s chief operating officer (COO) Gagandeep said that the firm wants to get relieved from the burden of the locality.
However, the RWA refused to subscribe to the assertion due to the violation of the Haryana Apartment Ownership Act 1983. According to the Act, there should be one condominium association which will be legally transferred to the administration. But since Ansal API has sold a part of the unit (12.5 acre) to two builders and they have developed two independent units (of Sushant Apartments) each having their own registered body. At this situation, the RWA is reluctant to take up the responsibility, explains SC Dutt, president of Sushant Apartments.
In the early 1990’s, Ansal API had received licence to develop a condominium on 12.5 acres at Sushant Lok-1. Later, it sold over 50 percent of its land to two other developers who built Maple Height and Maple Crescent. But as per the Act, the realtor was supposed to form one condominium consisting of the three units and transfer administration (including common assets). This now seems to be impossible.
The RWA claimed that the developer is just faking the transfer offer is as it is under pressure from the town planning department which has directed Ansal API and 34 other developers to transfer maintenance of condominiums to the local RWAs.
