Co-op societies striclty asked not to sale land without permission by HC
Delhi-NCR : The new rule from the Delhi high court have restricted transfer and sale of plots by owners from housing societies.
Soami Nagar cooperative house building society has recently been penalized by Justices Sanjay Kishan Kaul and Vipin Sanghi for the sale of a plot by its member to an outsider.
The society has a rule, i.e, only Radha Soami faith/sect can purchase the plot. Although High court held this rule as a bad regulation and requested the Registrar to remove such rules from the society.
The society has become a property broker to earn profit. HC has strictly asked the new owners to be a member of the society first then to apply for plot. This rule should be followed for both buying and selling. People who are not members of a sect of religious beliefs of Hindu will have to register in the society through documents.
The Judge has observed that business was not the intention of the society but to transfer the rights of the plot. The society is playing like a broker to earn profit by selling the land without any permission.
