SC directed BMC to raze illegal buildings in Worli

Illegal buildingBrihanmumbai Municipal Corporation (BMC) has been directed by the Supreme Court to clear down six illegal buildings at Worli Naka.

The six buildings have occupants who have moved into the units twenty five years back.

The illegal buildings which include Esha Ekta, Patel, Orchid, BY, Midtown, and Shubh had been constructed by four seperate developers on a single plot that used to house Pure Drinks, the manufacturers of Campa Cola.

The builders, then were granted to develop only G + 5 floors. But Midtown went up to constructing 20 floors, Orchid to 17, Esha Ekta to 8, Shubh to 7 and Patel to 6 floors each.

This is not the first notice that has been sent to the developers. First notice was sent in late 1984 by the BMC to the developers, but no action was taken and the flats were occupied thereafter.

Earlier, a petition had been filed by the residents requesting regularisation of the buildings in that area. However, an apex court division bench had ruled out the option of regularisation and stated that the violations could not be regularised and ordered the Brihanmumbai Municipal Corporation to take action at the earliest.

Now, the residents are planning to file for a review petition at the higher court which will be their final try. But, the civic body is all set with plans to demolish the illegal floors.

Also, the state government and its officers are already been directed to not put any hindrance in the implementation of the notice.

It has also been made clear that the flat buyers of these properties in Mumbai are all free to avail for appropriate remedy for their losses from the respective developers.

Many residents alleged that they were unaware of the illegalities the time they were buying flats. However, the division bench has a different story to tell.
