SC’s remark looks like a silver lining

No Comments Sub Category:Realty News Posted On: Jul 11, 2014

Supreme Court’s recent observation has come out as a silver lining for the residents of Worli’s Campa Cola Compound. However expertise in legal departments has turned out cautious as they worry this might pave the path for the regularization of built unauthorized floors of different compound buildings.  The Supreme Court had passed an order in February 2013 for this case. In that order the apex court had stated that the residents in Worli’s Campa Cola Compound had failed to provide a case which could make the Supreme Court direct the BMC to regularize the unauthorized constructions.

The division bench of Justices S J Mukhopadhaya and G S Singhvi stated that in no possible way will any authority abiding municipal laws or any other similar law allow or encourage the violation of the plan sanctioned for the project. Even the court cannot practice in regularizing unauthorized constructions or engage any law that could help violate the sanctioned plan. They further stated that by doing so they would pave in paths for destruction of the existing idea of planned development in rural and urban areas.

If any of these aforesaid rules would be violated the legal department of BMC will take necessary action.
