@Vikas Currently, female property owners have to pay stamp duty at 4.9 per cent of the market price of the property or the transaction value, whichever is higher. Men are charged a higher rate of 5.9 per cent. This difference in stamp duty rates is aimed at empowering women and motivating more families to register properties in the name of female family members. Registration fee remains the same for everyone at 1 per cent. also an additional VAT of 3.6 per cent has to be paid in case of new properties.

A sale deed is one of the most valuable legal documents in the purchase or sale of a property. The value of the sale deed will differ from state to state in the country and as prescribed by the Stamp Act of the respective State. A sale deed has almost all the details required to carry out the purchase or sale of a property. Most importantly the sale deed would require the seller to certify that the property under sale is free from any encumbrance and without any lien.
Thanks David for sharing information , I would like to add that the sale deed is registered at the jurisdictional sub-registrar’s office. Apart from the buyer and seller of the property under sale the witnesses should also be present at the time of registration. It would also clearly mention the exact date on which the seller would hand over to the buyer the original property related documents and the date of subsequent possession of the property under sale.

Q: I made a mistake of buying a villa at Media village, Greater Noida from Jamil Khan of Samiah Builders in 2008. I was foolish enough to pay all the money upfront. I was promised that the colony will be completed in 2009. It is now 2013 and the place still looks like a ghost town. Construction work stopped 2 years ago and Mr Khan is not owning up to his responsibility. None of the promised parks, swimming pools, common room, children play area sauna etc have been completed. I am still waiting for the interior work like fitted kitchen, bathroom, floors and decorations etc to be completed in my villa. As it is unlikely that Mr Khan would own upto his responsibility, my advice to everyone out there is to deal with another reputable builder and believe me Mr Khan is not one of them.. YOU HAVE BEEN WARNED

As per sources, the average residential price of this sector was around 3272/sq-ft in year 2011. After many ups & downs this price has touched around 5355/sq-ft in year 2015. Definitely investment is a good option here. Sector is developing, many well known builders are engaging them self here. Commercial & residential projects are developing in this sector. It may take a while but investment return will be good.

Your budget may fall short of the price for a 3 BHK flat but you will get 2 BHK in this range. This may be viable in a project that's simply being launched and is at very initial phases.I think you would contact the local authority for such expertise and seize the possibility.

Q: Dear all, i invested in laxmi niwas project in april-2012 in installment. at the time of booking they made very promises, like registry and etc. I have made more than 43% of payment but no reply from the company instead of to make timely payment. I stop the payment, They only called me for the payment but if i asked them for the registry they told me to wait. I emailed them and told that cancelled my plot, but no response. Then i visited there small office, the staff with no knowledge of the company process, i told them either to take the all payment or cancell my plot and give my all the money back. The company director Mr. Ghanshyam (with very rude attitude) said that the amount you paid till now the 25% deduct and the money will refund also in installment. I was shocked. At that time i did not have any choice. I have a hard earned money. I requested you to all not to invest even a single paisa in these kind of pre launch projects.

Apropos your above comments pls be apprised that you took a plan of payments in 12 Installments wherein you paid just 4 of them till August 2012. Thereafter you disappeared and have been a CHRONIC DEFAULTER. Then after ONE YEAR you appeared with a NOTARY ATTESTED Requisition for Cancellation of plot and Refund of what ever little Amount Paid - citing your inability and poor financial conditions. Heeding to your request your all payments were refunded immediately on the same day as per company norms and you issued proper receipts with a note of satisfaction. The said documents are in record with the Company. Thereafter putting such an irresponsible, insensible and derogatory statements shall only invite a stern legal action against you. It is better we unite and sort it out with the developer. If required we will seek indulgence of the police and the judiciary. Q: I am dealing with a builder for a plot which is just beside Janachaitanya phase 3 layout in Upperpally. Named "Peace homes" The land that this builder has is a small gated community which is beside Janachaitanya phase 3 layout which is HUDA approved. However, the land which this builder has is grampanchayat approval, he says he can get LRS and GPS but I have to pay for it. Is this option good? what will be the cost for it? Will I get home loan for construction on the land after getting LRS? Please advice.

The altar on which the idols are placed should be located in the northeast corner of the room. 3. The altar should be placed at least 2.5 inches from the wall and should not be fixed to the wall. 4. The idols and pictures of deities should be placed facing east or west and never the north. 5. The south-east direction is considered to be ruled by Agni (the God of Fire), and so the lamp should be placed facing that direction.

Q: I want to buy a property at Kolkata ( a residential flat) jointly with my son almost with 50 % contribution from each of us. My initial payment will be by breaking my bank fixed deposits and the balance payment from the sale proceeds of my property (flat) for which seller-buyer agreement has been done. My question is if my payment for the new property is more that what I receive from selling my present property (more than seven years old), then whether I can avail the Capital Gain Tax exemption u/s 54, even if the new property will be purchased jointly by me and my son. If I buy a property first at Kolkata investing from my own savings (Bank Fixed Deposits) and later on within a year I sell my Gurgaon flat and invest the sale proceeds investing in Bank Fixed Deposits, am I eligible for capital gain exemption, obviously if the buying price is more than the selling price.

Q: Hello all, I am planning to buy a MUDA site at Mysore which is in the following condition. The property was purchased by a person who has died now. It shall be transferred to this mother's name as he was unmarried at the time of his death. The original buyer who has died had bought it from a person who was alloted the site from MUDA. They are in the process of doing the khata transfer from the deceased son's name to mother's name. They have all the documents like Sale deed, Possession certificate, Old khata, Allotment letter and latest Encumberance Certificate. Only thing they don't h ave is the Title deed. They are telling they have not taken it as yet and now since the owner has died they cannot take it now. Only thing they can do is khata transfer at MUDA, Mysore. I am not sure if they are right. Can I buy such a property where everything is clear except for this. How essential is a Title Deed when the Sale deed is there. Is sale deed a sufficient document or I need to insist on Title Deed. Informed Rs 5000 as incidental charges for registration (Pl check mail dated 06 Sep 15), but collected Rs 7,500 at the time of registration. 4. No constructive effort has been made to rectify the snags pointed out. Through and through crack on concrete wall (visible both sides of the wall at same place) acknowledged by L&T but putty has been filled to cover that crack in concrete. I am from Dhaka and work in a private import-export company in Chandigarh. Initially company used to provide the accommodation but as the size of the company grows they changed their policies and started giving other benefits and stopped accommodation facility. However, as per my knowledge Manikonda comes under gram panchayat and the permission is for G+2 only. However, Building plan is approved by builder for G+4. So, Please suggest me in this regards...
Before investing in Manikonda, you need to check for disputes and risks. The land you are interested in might be a matter of dispute which has well-concealed by its owner.This area comes under gram panchayat and for any construction you have to take prior permission . In your case check all document from builder side to check the legal part.

Q: Hi, I am getting new Flat possession with in 2-3 months which is already delayed one year by Builder. In Final payment they are asking following: Maintenance charges (for 2 years) , Sinking fund (payable at the time of possession & finally handover to society) and Club membership (Payable on completion) My township has 10 towers and only 5 towers is launched and under construction. GYM, Swimming pool, sport complex like amenities are not started and as per them it will be grounded after complete township I believe 10 years later from now. So what are the charges actually payable because these is not beneficial for me in couple of future years.

For residential plots, make sure your desired location is near some upcoming SEZ or commercial region to attract more resale value. Hello Patel, Stamp duty is levied by state, it does not depend upon project to project.Stamp Duty is a kind of tax collected by the Government of a state on every document by which any right, title, interest or liability is created, transferred, extended, extinguished or recorded. Stamp duty payable for registration of property is different and varies in various states/cities in India.
Currently, female property owners have to pay stamp duty at 4.9 per cent of the market price of the property or the transaction value, whichever is higher. Men are charged a higher rate of 5.9 per cent. This difference in stamp duty rates is aimed at empowering women and motivating more families to register properties in the name of female family members. Registration fee remains the same for everyone at 1 per cent. also an additional VAT of 3.6 per cent has to be paid in case of new properties.

Normally in TNHB allotment schedule of property the footprint of the flat shared with others alone is mentioned in the Sale Deed and not the overall size of the plot. Hello Naidu, There is list of documents required for obtaining Patta includes: 1. Sale deed/ Title deed after registration 2. Parent document 3. If another plot in the layout obtained a patta, include it as an unofficial reference. It is not an official requirement 4. If it is Patta transfer, include legal document such as will, legal heir documentation, etc. 5. If the building is present, include plan documents. 6. Include tax receipts. 7. Pay relevant fees 8. A survey may be required. Providing a Patta sample from neighboring plot as an unofficial requirement may help avoid a survey. 9. Apply to the concerned Tehsildar or any appropriate administrative authority in a format prescribed by the Revenue Department. 2. Enclosed documents tat pertain to the plots ans details of the owner. 3. An interview might be sought by the Tehsildar with the applicant if needed. 4. If the Tehsildar is so convinced, an on-site visit is also possible. But these are generally for lands that are entangled in legal disputes.

Q: I am buying an individual house in agated community for 40 laks in andhra pradesh. Out of the 200 sq yards land, house will be built in 1250 sft by the builder. While at the time of buying he said market rate of 12000 per sq yard land and 1300 per sft for construction. But the government price for the land is 5000 per sq yard so land was registered for 10 lakhs before starting the construction. There is no registration for the remaining 30 lakhs. Now builder is demanding 3.5 % service tax and 1.25 % vat tax on the 40 lakhs. My questions here are, as there was no registration for the 30 lakhs, will the builder really pay these taxes to the government, if yes how i will know that ?, He gives only company bills for the taxes not the government bills. Is it correct to calculate service and vat taxes on 40 lakhs. Should he calculate these taxes only on 16.25 laks (only for construction). Please anyone can help me in this regard.

Thus, for all under construction properties below Rs 1 crore or below 2000 sq. ft. area, the service tax applicable is 14 per cent of 25 per cent of the total agreement value. But for under construction properties that exceed or equal to Rs 1 crore or are over 2000 sq. ft. area, the service tax applicable is 14 per cent of the 30 per cent of the total agreement value

Recently I came across this project, I like the way the layout plan is designed and I also contact with the builder to know more about this project. I got full details and information about this project and I am satisfied with the builder reputation. The rate per sq ft is Rs 3000 and I think it is quite reasonable rate as per current trends in this area.

We made this purchase as an investment point of view so that we can rent out the apartment which would yield us anywhere btw 20K to 25K. But after completion when we visited our house. Perumbakkam is a great location, calm place with just good ground water reachable for all its sectors and predominant junctions like Tambaram and Medavakkam. Residential Projects in this area are within the price band of INR 3500 psf- INR 4300 psf, relying on the area, specification and builder. Metro development will obviously appeal to consumers as well because the increase of demand of residential project in this area.
Malles is one of the reputed builders in Chennai. The project is located in the heart of the city at Kodambakkam and is a very impressive mission. It's well designed and can definitely admire very good location. Water logging is common in some parts of the area, but most of the residences use rain water harvesting and other such options to control it. It should not be major crisis with Malles Radhe Krishna.

You are absolutely right. This will only benefit builders and politicians. Why can not the government plan affordable housing in the interiors of Mumbai where CRZ violations are not a concern.

Q: Hi, We have a individual house (ground floor) constructed 25 years ago. The type of construction is load bearing wall construction. We are planning to construct a floor on top of it. The whole area is rock area and the current strength of the walls are good. Each wall is around 16 inches. While contacting different builders/contractors they are suggesting that we demolish the whole house and build fresh with pillars. We dont want to got that way. Hi Rishi, Numerous buyers are waiting for their homes and have not received any compensation from the builder. The wait is particularly tough for those whose is paying huge EMI. So what should one do in that situation?
Your first option should be cancellation but it can be a laggard process. If buyers insist, they refund the money after deducting 10-15% of the value of the property. While some deduct 10% of the booking amount, others quote the same figure on cost of property. Small developers may forfeit the entire booking amount. There is no standard guidelines for refunds.

Q: I have purchased a flat in Kaikhali Kolkata, where sale deed made on Feb, 2014 on 20% of 20L total money. Final deed made on Dec, 2015 with loan from SBI, with 7.1% of govt evaluation 23L of the property cost. Completion Certificate is not issued yet and Possession letter is also provided. My question is if Service Tax is applicable for me?

I think Service tax is not applicable in your case, Service tax is levied only on under construct property not in completed projects.
The buyer is liable to pay the builder Service Tax at the time of purchase of property, which the builder will inturn deposit with the Govt...And if the Builder does not collect Service Tax separately, it would imply that the amount paid by the buyer is inclusive of Service Tax... so if you dont pay additional service tax to the builder and the sale deed has been registered, he would have to pay out of his own pocket..

Manoharan Menon, officer on special duty, Cidco said that they have circulated the notice to all the four buildings on Cidco land, asking to vacate their homes by December end. After the court hearing on January 5 and 6, they will begin action against these buildings.

Hi I think first of all, you required filing an application to the commissioner of the land revenue department that comes under city authority. Within the utility, you have to give an explanation for the reason of conversion.
The conversion cost relies on the character of the property, vicinity and the area of the property. It varies from one state to one other. Once you pay the cost, you have to acquire the receipt of the cost as proof.

Which all financial institutions and local body has approved the project? Is the builder providing OC and Khata?
Yes Builder has taken approval from CMDA for the project and project has no issue with the legal documentation part. All paper are clear. Banks like Axis bank, LIC, HDFC, Indiabull got approval for this bank and also various bank approach for approval of this project as off now. You can avail home loan easily for this project.

I am planning to invest in this project and want to know what kind of configuration they are offerings and what is the price going on? Is it good place to for future investment?
Currently the rate per sqft going on in this project is Rs 2700 and the project is spread over 32 acres of land with 48 towers having total 3314 unit with a combination of 1. 2 and 2.5 BHK units.

Q: Had a good pre-selling and good response for payment clearances and registration. The post selling support and possession is not going so great or even meeting builder's own timelines. Was interested in knowing how have been experience of others who has put money in this project.

@Amreesh, The Airports Authority of India will have an option to hold 5% in the project. Tariffs at the Navi Mumbai airport will calculated on a ''shared till'' basis and 30% of non-aeronautical revenue will be used to cross subsidise aeronautical charges during tariff determination.

Hi Sadhana, The proposed SPV will be headed by the vice-chairman of the Bhubaneswar Development Authority (BDA), currently Krishan Kumar. For now, the Bhubaneswar Municipal Corporation (BMC), the state housing and urban development department and other government agencies will hold stake in the SPV. Later, private players will be attached.
Hi Aveek, It is true. But at the same time, there will be a high-power steering committee, to be headed by chief secretary A P Padhi, to oversee the projects. A proposal regarding delegation of power to the SPV will be placed before the state cabinet. Once the SPV is formed, the state government will demand funds from the Centre to implement different projects.

Hi Govinda, Thanks for the information. Is it the same owner (Clariant Chemicals India) who sold the land parcels to Lodha Developer in 2014 for Rs. 1154.25 crore?
And one more thing that i want to add that around 60% of the total residences have been acquired already by home-buyers under the pre-launch. This buyers have not only created the demand in a highly competitive market such as Thane but also revived its real estate landscape by reinforcing people's towards appreciation and investment in real estate.

I think this is the right move by the Finance Minister as well as NDA Govt. Since January 2015, RBI had cut 150 basis points, including Tuesday's rate cut. In the September 2015, the key rates were cut by 50 basis points, but this has not benefited retail borrowers in equal measure. The beneficiaries are educational institutions imparting primary and secondary education, medical institutions, institutions promoting sports, amusement parks, arts and sciences, charitable institutions, penal institutions like jails, mental hospitals, house of correction, detention and reformatories and special cases closely associated with promotion of cultural and other activities are coming under it. These are nothing but the trick of Congress party to create an an issue on the project and stalled it. In the middle of the row over unplanned smart city project coming up in the luxurious Shivaji nagar and Tulsi Nagar Areas of Bhopal, congress general secretary Digvijaya Singh has demanded that before implementing the project, the government should first decide rehabilitation of the affected families.
Yes, congress is saying that it will lead to uprooting of 30000-40000 trees which not only provide fresh air but have also made the area already Smart. I think congress are becoming very smart.
